SERGIO AGUERO has refused to accept his three- match elbow ban.
Manchester City will claim today that referee Andre Marriner MUST have seen the clash with West Ham’s Winston Reid.

The skirmish last Sunday is still set to cost the Argentina hitman, 28, his place in the derby at Old Trafford a week tomorrow.
City were granted an extra 24 hours to respond to the violent conduct charge FA beaks levied on Aguero on Tuesday.
But shortly before last night’s 6pm deadline, City informed the FA they would contest the charge.

Ref Marriner did not see the incident. But a three-man panel of former Prem refs agreed Aguero was guilty of a red-card offence that would bring an automatic three-match ban.
The refusal of City and Aguero to accept the ban means an Independent Commission will sit today.
VINCENT KOMPANY has come through a behind-closed-doors practice match.
The City captain played both 25-minute halves but is not ready for first-team action yet.
